  1. Scope, Definitions, and Organiser

1.1 These terms and conditions apply to the competition held at the "IAW Fair, International Promotional Goods and Import Fair" in Cologne and serve the purpose of promotion (hereinafter referred to as the "Competition").

1.2 The Competition is conducted by Nordwestdeutsche Messegesellschaft Bremen-Hannover mbH, Heidplackenweg 9, 26209 Hatten, Germany (hereinafter referred to as the "Organiser").

1.3 These terms and conditions apply exclusively.

  1. Eligibility for Participation

2.1 Eligible to participate are individuals who have reached the age of 18 and reside either within or outside the Federal Republic of Germany. Should a participant have limited legal capacity, the consent of their legal representative is required. Regardless of the participant's place of residence, the law of the Federal Republic of Germany applies to all participants.

2.2 Employees of the Organiser, any agencies involved in the preparation or execution of the Competition, and any other companies involved in the preparation or execution of the Competition, as well as their immediate family members and partners living in the same household, are excluded from participation. The involved companies include Dipl.-Betriebswirt Ulrich Zimmermann, Sonderposten, Einzel- und Großhandel, Im- und Export, GmbH, and Haushalt International Import- und Export GmbH, as well as Nordwestdeutsche Messegesellschaft Bremen-Hannover mbH. Participation with false identities or identities of third parties is not permitted.

2.3 Participation is limited to customers of the Organiser and depends on obtaining a free VIP ticket for the September IAW Fair 2024 via the employee, Ms. Kristin Krebstakies, by email: krebstakies@iaw-messe.de. Participation does not require the purchase of a paid product or service.

2.4 The Organiser reserves the right to exclude persons from participation at its discretion if there are justified reasons. Such reasons include:

  • Manipulation related to access to or conduct of the Competition
  • Violations of these terms and conditions
  • Unfair actions or
  • False or misleading information in connection with participation in the Competition If the excluded participant is an already drawn winner, the prize can be revoked retrospectively.
  1. Participation in the Competition

3.1 To participate in the Competition, it is necessary to obtain at least one free VIP ticket for the September IAW Fair 2024 via the employee, Ms. Kristin Krebstakies, by email: krebstakies@iaw-messe.de, and to register and submit the competition form within the promotion period. Personal details (first and last name and email address) are required for participation. Each person may only participate once in the Competition. Participation through automated mass participation processes is not allowed.

3.2 Among all eligible participants, the Organiser will raffle the following prizes:

  • 10 exclusive IAW VIP packages
  • 1 overnight stay for one person in a single room at a 4-star hotel in Cologne from 04.09. to 05.09.2024
  • 1 IAW merchandise bag (including IAW merchandise products such as a glass bottle, pen, and notebook)
  • 1 ticket for the IAW Fair exhibitor party on 04.09.2024 at the Chocolate Museum If consolation prizes are included in the Competition, all valid participants who did not win a main prize will receive a consolation prize while supplies last.

3.3 The following special agreement applies to the hotel stay: The hotel will be announced upon the winner's notification. Travel expenses are the responsibility of the winner. If the winners wish to avail themselves of additional services at the hotel beyond the overnight stay, these must be borne by the winner and not by Nordwestdeutsche Messegesellschaft Bremen-Hannover mbH. If circumstances arise that are beyond the Organiser's control, the winner accepts an appropriate replacement prize. If the trip does not take place at the date or time specified in the Competition for reasons beyond the Organiser's control, there is no longer any claim to the prize.

  1. Participation Period

4.1 The Competition ends on 20.08.2024 at 16:00.

4.2 Participation is only possible within the participation period. Entries received after the participation deadline will not be considered in the draw.

  1. Conduct of the Competition and Determination of Winners

5.1 The determination of the winners will take place within one week after the end of the promotion period through a random draw among all participants.

5.2 Only one prize per participant is possible.

  1. Winner Notification and Prize Distribution

6.1 Participants who are winners of the Competition will receive a winner notification via email with exact instructions and descriptions on how to receive their prizes and which 4-star hotel they will stay in. Notified winners are requested to respond within a period of 6 working days using the provided contact details of Nordwestdeutsche Messegesellschaft Bremen-Hannover mbH. If the winner's contact details are incorrect (wrong email address), the Organiser is not obliged to investigate the correct address. Any disadvantages resulting from the provision of incorrect contact details are the responsibility of the participant. If the winning participant does not respond within six working days, the prize claim expires. In this case, the Organiser is entitled to conduct a substitute draw and transfer the prize to another participant.

6.2 Exchange, transfer, assignment (including individual components or replacement of the prize), or cash payment of the prize is not possible. A participant can forgo the prize. In this case, the next participant in the winner ranking moves up.

6.3 Additional costs associated with claiming the prize are the responsibility of the winning participant.

6.4 The prize will be handed over between 03.09.-

04.09.2024 during the opening hours from 09:00 to 18:00 at the fair office at the event "IAW Fair, International Promotional Goods and Import Fair" in Cologne. Winners are required to personally collect their prizes from the employees of Nordwestdeutsche Messegesellschaft Bremen-Hannover mbH at the fair office, presenting their ID for verification. If the winner does not collect the prize by 18:00 on 04.09.2024, the prize claim will expire without replacement. Upon handover of the prize to the participant, the risk passes to the participant.

6.5 The participant who has won is responsible for any taxes on the prize.

  1. Termination of the Competition

The Organiser reserves the right to terminate the Competition at any time, even without adhering to deadlines, without prior notice, and without giving reasons, in whole or in part, prematurely or to change its course if it is not possible to guarantee the proper and planned execution of the Competition for technical (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons.

  1. Reporting by the Organiser

8.1 Nordwestdeutsche Messegesellschaft Bremen-Hannover mbH will announce the winner via an email circular to all participants. Participants agree that their first and last name may be publicly named in the circular if they are among the winners.

8.2 There will be no publication of the winners by the Organiser on social media channels.

  1. Liability

9.1 The Organiser is fully liable for damages resulting from injury to life, body, or health. Furthermore, the Organiser is fully liable in all cases of intent and gross negligence.

9.2 If essential contractual obligations are affected, the Organiser’s liability for slight negligence is limited to the contract-typical, foreseeable damage. Essential contractual obligations are obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance the participant regularly relies.

9.3 For the violation of non-essential contractual obligations, liability for slight negligence is excluded.

9.4 The above exclusions and limitations of liability also apply in favor of the employees, agents, and other third parties used by the Organiser to fulfill the contract.

  1. Withdrawal from Participation

Participants are free to withdraw their participation in the Competition at any time. The withdrawal must be declared to the Organiser.

  1. Data Protection

The Organiser uses the participants' personal data to conduct the Competition. The legal basis is Art. 6 para. 1 lit. b GDPR. The winner's data will be deleted four weeks after the end of the Competition. The Organiser only transfers the data to service providers who help him to carry out the Competition. Participants have the right to access, rectify or delete, restrict or object to the processing of their data, as well as the right to data portability. Participants also have the right to lodge a complaint with the supervisory authority.

  1. Final Provisions

12.1 Legal recourse is excluded.

12.2 The law of the Federal Republic of Germany applies to the Competition and these terms and conditions.

12.3 Should any provision of these terms and conditions be or become invalid, the validity of the remaining terms and conditions shall not be affected. The invalid provision shall be replaced by a legally permissible provision that comes closest to the economic purpose of the invalid provision. The same applies in the event of a regulatory gap in these terms and conditions.

Purposes and Legal Basis of Data Processing

We process your personal data in compliance with the EU General Data Protection Regulation (GDPR), the Federal Data Protection Act (BDSG), and all other relevant laws.

When participating in the Competition, we process the following data from you:

  • Name, first name, phone number, and email address In case of winning, we additionally process the following data from you:
  • Address Conducting the Competition is not possible without processing your personal data. The legal basis for these data processing purposes is Art. 6 para. 1 lit. b GDPR.

Additionally, we process your personal data to fulfill legal obligations, such as regulatory requirements or commercial and tax retention obligations. The legal basis for this processing is the respective legal regulations in conjunction with Art. 6 para. 1 lit. c GDPR.

Should we wish to process your personal data for a purpose not mentioned above, we will inform you in advance within the legal requirements.

Categories of Recipients of Personal Data

Your data will generally not be disclosed to third parties unless the disclosure is necessary for the execution of the Competition or the dispatch of the prize, and there is a data protection authorization to transfer.

External Service Providers

We use external service providers to fulfill our contractual and legal obligations.

Other Recipients

Additionally, we may transfer your personal data to other recipients, such as authorities to fulfill legal reporting obligations (e.g., social security institutions, tax authorities, or law enforcement authorities).

Data Storage Duration

We delete your personal data as soon as they are no longer required for the above purposes. It may happen that personal data are retained for the period during which claims against our company can be asserted (legal limitation period of three or up to thirty years). Furthermore, we store your personal data as long as we are legally obliged to do so. Corresponding evidence and retention obligations arise, among other things, from the Commercial Code, the Tax Code, and the Money Laundering Act. The retention periods are up to ten years.

Rights of Data Subjects

You can request information about your stored data at the address mentioned above. Furthermore, you can, under certain conditions, request the correction or deletion of your data. You may also have the right to restrict the processing of your data as well as the right to receive the data you have provided in a structured, commonly used, and machine-readable format.

Right to Object

You have the right to object to the processing of your personal data for direct marketing purposes. If we process your data to safeguard legitimate interests, you can object to this processing if there are reasons arising from your particular situation that speak against the data processing.
